1. Introduction and Acceptance

Welcome to CreativeSpectrum. These Terms of Service ("Terms") govern your access to and use of CreativeSpectrum's website, products, and services ("Services"). These Terms create a legally binding agreement between you and CreativeSpectrum ("we," "us," or "our").

3. User Accounts and Responsibilities

In order to access certain features of our Services, you may be required to create an account. When you create an account, you must provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device.

You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this section.

You may not use our Services if you have been previously removed or banned from using our Services. You may not sell, transfer, or assign your account to anyone else without our prior written consent.

4. Intellectual Property Rights

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, software, and the design, selection, and arrangement thereof, are owned by CreativeSpectrum, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

These Terms permit you to use our Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
You may store files that are automatically cached by your web browser for display enhancement purposes.
You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.

Student Work

As a student, you retain ownership of the intellectual property rights to the original work you create as part of your coursework. However, by submitting your work, you grant CreativeSpectrum a non-exclusive, royalty-free, worldwide license to use, reproduce, distribute, and display your work for educational, promotional, and marketing purposes.

If you do not wish for your work to be used in this manner, you must notify us in writing before submitting your work.

5. Payment Terms

Course Fees

All course fees are listed in Euros (€) and are inclusive of applicable taxes unless otherwise stated. You agree to pay all fees specified when you register for a course. Course fees are subject to change, but changes will not affect courses for which you have already enrolled.

Payment Methods

We accept payment by credit card, debit card, bank transfer, and other payment methods as specified on our website. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.

Installment Plans

For certain courses, we may offer installment payment plans. If you choose to pay in installments, you agree to make all payments according to the schedule provided. Failure to make timely payments may result in suspension or termination of your access to the course.

Late Payments

If your payment is not received by the due date, we may charge a late fee or suspend your access to the course until payment is received. Continued non-payment may result in termination of your enrollment and referral to a collection agency.

Refund Policy

We offer a limited refund policy for our courses:

Full refund if requested within 7 days of enrollment and before attending any classes
50% refund if requested within 14 days of enrollment and after attending no more than 2 classes
No refunds after 14 days of enrollment or after attending more than 2 classes
No refunds for digital materials that have been downloaded or accessed

6. Cancellation and Termination

You may cancel your enrollment in a course at any time by contacting us through our contact form or by email. Refunds will be issued according to our refund policy as described in the Payment Terms section.

We reserve the right to terminate or suspend your access to all or part of our Services, without prior notice, for any conduct that we, in our sole discretion, believe violates these Terms, infringes on the rights of CreativeSpectrum or third parties, or is otherwise inappropriate.

We reserve the right to cancel, reschedule, or modify any course at our discretion. In the event of a course cancellation, we will provide a full refund of the course fee or offer you the option to transfer to another course. We are not responsible for any other expenses you may have incurred in relation to the canceled course.

Upon termination of your account, your right to use our Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Limitation of Liability

IN NO EVENT WILL CREATIVESPECTRUM, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, OUR SERVICES, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

You acknowledge that we have made our Services available to you and priced them in reliance upon the warranty disclaimers and limitations of liability set forth herein. We would not be able to provide the Services to you without these limitations.

8. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Cyprus, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the courts of Cyprus. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Alternative Dispute Resolution

Before filing a claim against CreativeSpectrum, you agree to attempt to resolve the dispute informally by contacting us. We'll try to resolve the dispute by contacting you via email. If a dispute is not resolved within 30 days of submission, you or CreativeSpectrum may bring a formal proceeding.

9. Changes to Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the website thereafter.

Your continued use of the website following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

We will make reasonable efforts to notify you of any material changes to these Terms. Such notification may be made by sending an email to the email address associated with your account, by posting a notice on our website, or by other means.
